These Terms and Conditions ("Terms") govern the relationship, use of the website, and all procurement and delivery transactions between Paragon Dash (Pty) Ltd (hereinafter referred to as "the Company", "we", "us", or "our") and any user, contractor, or visitor utilizing our platform (hereinafter referred to as "you", "your", or "the Customer").

By accessing this website, creating an account, or placing an order, you unconditionally accept and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the platform.

1. Legal Status and Independent Intermediary Disclosure

• Independent Procurement: Paragon Dash operates as an independent, third-party procurement and on-demand logistics delivery platform. We are not an authorized agent, partner, or joint-venture entity of any hardware manufacturer or supplier whose products are listed on our site.

• Reseller Framework: We source authentic products from major regional distribution hubs directly against real-time customer orders placed on our website.

• Governing Law: This website and these Terms are exclusively governed by and interpreted in accordance with the laws of the Republic of South Africa. The company chooses as its domicilium citandi et executandi its registered corporate address in Cape Town, Western Cape.

2. Product Availability and Third-Party Pricing

• Just-in-Time Sourcing: All product availability displayed on our online storefront is subject to the real-time stock levels of our primary third-party supplier distribution hubs.

• Stock Discrepancies: While we take reasonable measures to ensure inventory accuracy online, we cannot guarantee that a product is physically available on the supplier's shelf at the exact second of purchase. If an item is out of stock at the fulfillment hub when our driver arrives:

  • We will immediately notify you via SMS, phone call, or email.

  • We will offer you an alternative product option, a revised delivery window, or a full, immediate refund for the unavailable item.

• Price Amendments: We reserve the right to modify, update, or adjust product listings, descriptions, and delivery fees at any time without prior notice to reflect supplier price adjustments or logistics variations.

3. Financial Transactions and Card Security

• Currency and Location: The merchant outlet country is the Republic of South Africa. All payment options presented are processed in South African Rands (ZAR).

• Payment Gateways: Online payments are cleared securely using integrated, PCI-compliant third-party e-commerce payment gateways.

• Data Security: No credit, debit, or transactional card information is stored on the Paragon Dash server. All financial encryption complies with international Secure Socket Layer (SSL) parameters via our gateway partners. Customer identity details are securely separated from processing strings.

4. Same-Day Express Delivery and On-Site Risk Protocols

Paragon Dash is engineered to maintain live project momentum. Because our operation interfaces directly with live trade environments, our delivery windows are structured as flexible, on-demand lifecycles:

• The On-Demand Delivery Window: We provide a premium same-day express delivery service. Our operational timeline ranges from a best-case scenario of 30 to 60 minutes up to a maximum fulfillment buffer of 2 hours (120 minutes) from the moment your order confirmation and payment clear.

• Fulfillment & Operational Variables: You explicitly acknowledge and agree that our exact arrival times are dynamic. Delivery windows are heavily influenced by real-time variables beyond our direct control, including:

  • In-store packing queues and picking delays at the supplier's trade desk (where up to 30 minutes is strictly allocated for the supplier to fulfill the order package).

  • The overall volume, weight, and complexity of the hardware ordered.

  • Metropolitan traffic congestion, road layout constraints, or adverse weather hazards across the Cape Peninsula.

• Site Coordinates: Deliveries are executed on-demand straight to the specific address, site location, or GPS coordinates provided by you during checkout. It is your sole responsibility to ensure an authorized representative is present to receive the materials.

• Transfer of Risk: All risk of damage, accidental loss, or destruction of the purchased hardware passes completely to you the moment our delivery driver completes the hand-off at your site coordinates and obtains a digital signature or verification snapshot.

5. Strict Returns, Cancellations, and Defective Items Policy

Because Paragon Dash operates an immediate, on-demand procurement pipeline where materials are purchased from trade desks specifically on your behalf, our returns policy is structured as follows:

5.1. Final Sale Status (No Standard Return Policy)

• No Change-of-Mind Returns: Once an order is processed on our storefront and procurement has commenced at the supplier hub, the order is considered final. We do not accept returns, exchanges, or refunds for correctly supplied items due to a change of mind, over-ordering, or project variations on your end.

• Custom / Cut-to-Size Exclusions: Any items cut to size, specially ordered, or altered by the supplier to fit your project requirements are entirely non-refundable and non-exchangeable under any circumstances.

5.2. Defective or Incorrectly Supplied Items

• Immediate Inspection: You are required to thoroughly inspect all hardware, runners, hinges, or adhesives immediately upon delivery hand-off at your job site.

• Reporting Window: If an item is physically broken, mechanically defective, or does not match the invoice description ordered on our site, it must be reported to our delivery driver on the spot or submitted via email to paragondash1@gmail.com within 24 hours of delivery, accompanied by clear photographic evidence.

• Fulfillment Correction: For verified defective items or packing errors caused by us, we will swap the item at no extra delivery cost or process a full refund within 7 business days.

• Supplier Warranties: Long-term product manufacturing defects fall strictly under the primary manufacturer's or supplier's structural warranties. Paragon Dash will provide you with the original acquisition data to assist you in making a claim directly with the supplier, but we accept no structural liability for product longevity.

6. POPIA Compliance and Privacy Protection

In accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA), Paragon Dash is fully committed to safeguarding your operational information:

• Collected Data: We only collect necessary functional identifiers required to process your e-commerce order and guide our delivery tracking (Name, Surname, Business Name, Delivery Address/Coordinates, Email, and Mobile Number).

• Third-Party Logistics Sharing: You explicitly consent to us sharing your name, contact phone number, and site coordinates with our integrated logistics software partners and active delivery drivers solely for the purpose of executing the physical delivery drop.

7. Limitation of Liability and Indemnity

• Site Disruptions: Paragon Dash shall not be held liable for any direct, indirect, incidental, or consequential damages, financial losses, loss of profits, or labor penalties suffered by your contracting business due to delivery delays, supplier stock-outs, or unserviceable hardware components.

• User Indemnity: You hereby indemnify and hold Paragon Dash (Pty) Ltd, its directors, and its operational staff completely harmless against any third-party claims, liabilities, or losses arising directly or indirectly from your implementation or utilization of hardware materials delivered via our platform onto live construction projects.

8. General and Variations

• We reserve the right, at our sole discretion, to modify or update portions of these Terms and Conditions at any time without prior individual notification. Amendments become fully enforceable the moment they are updated live on the storefront.
